On 4 July 2025, the EU Commission adopted a new delegated act on the Taxonomy Regulation (Regulation (EU) 2020/852) and issued a FAQ document plus filled model reporting templates.
The delegated act comprises a delegated regulation with 16 annexes, which amends the delegated regulation on reporting (Delegated Regulation (EU) 2021/2178), the delegated regulation on the two climate-related environmental objectives (Delegated Regulation (EU) 2021/2139) and the Delegated Regulation on the four non-climate-related environmental objectives (Delegated Regulation (EU) 2023/2486).
The changes to reporting include, in particular, the introduction of a materiality concept and changes to the reporting templates. The changes to the technical screening criteria include changes to the DNSH criteria with regard to the environmental objective of preventing and reducing pollution.
The new EU rules are intended to apply to the current financial year 2025, i.e. for reporting from 1 January 2026. However, there is an option to apply the changes at a later date (Article 4 of the Delegated Regulation). Both the EU Parliament and the EU Council may raise objections to the delegated act within a maximum of six months, but they cannot make any substantive changes. If no objections are raised, the delegated act will be published in the EU Official Journal and become directly applicable EU law.
The amendments were issued at the beginning of the year as part of the Omnibus I package (see DRSC briefing paper, in German only) and were subject to consultation. The DRSC submitted a statement on the proposed amendments to the EU Commission on 26 March 2025. The final EU regulations have also changed compared to the drafts that were consulted: For example, the provisions on the materiality concept have been reworded. The DRSC will shortly issue an updated briefing paper on the reporting requirements of the Taxonomy Regulation. The DRSC will continue to monitor developments relating to the Taxonomy Regulation.
